(San Antonio, TX) -- The case involving Texas' ban on gay marriage is headed to another federal court. Texas filed a motion in San Antonio yesterday saying it was taking the matter to the U.S. Fifth Circuit Court of Appeals. U.S. District Judge Orlando Garcia ruled Wednesday the 2005 voter-approved ban was in violation of the 14th Amendment. He issued a stay until the appeals court makes a decision. Gay marriage advocates expected the appeal and hope it means the U.S. Supreme Court will eventually rule on same-sex marriage.
